Given that's it's less than 24 hours into the investigation, the FBI may be waiting to see what evidence the Chicago PD and DA come up with. IANAL, but Federal hate crime charges may be the lesser charges than they'd face at the state level.

It seems like a DA could easily charge them with aggravated kidnapping - a conviction with a 6-30 year sentence plus 5-15 more added for further aggravating factors. To go from simple kidnapping to aggravated, the crime needs to include bodily harm, be against someone with a severe mental disability or include the commission of other felonies. They're probably 3/3 on that list. A hate crime charge could be added to increase the aggravating factors. Their disregard for human life in the video is definitely going to be a factor. It'd be hard to top a Class X felony that can get 6-55 years.

Since the kidnappers probably didn't cross state lines with their victim, a federal civil rights/hate crime charge may not be as severe.

IMHO, whatever conviction puts them in prison for the longest time works for me.

God I hope so, because this police job was absolutely horrible. They kept streaming for over an hour without the police breaking their fucking doors down, and then they claim it's not a race issue. Good god.

How the fuck does this go on for an hour with no one calling the cops??!! What kind of monsters live in Chicago and watched this without intervening?

“The offender said, ‘I hate white people’ and threw a punch,” Van Harten said in his ruling.

“There is no evidence either way about what the offender meant or whether . . . she holds or promotes an ideology which would explain why this assault was aimed at this victim,” he said.

“I am not satisfied beyond a reasonable doubt that this offence was, even in part, motivated by racial bias.”

I hate to think this way, but I can't help but imagine the city leaders in a room saying, "Look, if we piss off white people, we all know that riots won't destroy the city and freeways won't be terrorized with protesters." I personally hated Trump, but the campaign of lies directed against his supporters (by calling them out as Nazis at every turn) is what led to this mess. I normally hate saying things without facts to back me up but I feel like the 2% reported is far lower than the actual percentage, sadly.

If you continue to watch this clip Lemon also goes on to reveal that his view towards this is that 'if they don't understand the ramifications of torturing someone then they can't understand a political election' in a way to dismiss that this was possibly politicaly motivated too. So he's basically saying if someone's stupid enough to commit a serious crime then they're too stupid to consider race/politics in terms of their target. This line of thought suggests hate crimes are basically impossible in his world.

I get that he's just one talking head but it's a reason why people hate the MSM and especially CNN. Such garbage on there. Either he's intentionally stirring shit with that view (bullshit people are sick of) or he actually believes it (he's insane).

This is a hate crime on two counts:

  • Race (per their own words).

  • Disability (targeting due to it).

If you switched the races around I'd still want this prosecuted as a double hate crime. Plus kidnapping and torture is fucked up no matter what.

Why even have hate crime laws if they don't work when someone is specifically targeted due to a protected class (be it race or disability)? This seems completely textbook for why we have them and what they should prosecute with more severity.

They're trying to switch the conversation to one about abused mentally ill people. While I understand that there's a definite need to highlight this issue as well, clearly the aim here is to trivialize the racial and political context of this incident.

Yea and that should not happen. The police needs to call a spade a spade.

They may have PICKED this white guy because he was mentally disabled, but they DID THIS TO HIM BECAUSE HE WAS WHITE, AND THEY WANTED TO HURT A WHITE PERSON.

Everybody here fucking knows they wouldn't have done this to some crazy homeless black guy, which is a guarantee they had easier access to.

Ha, that sounded like the elementary school principal that my brother and I had. He'd get the shit kicked out of him by bullies every day and when my mom wanted to know why her son was coming home with black eyes and fat lips it was, "Heh, boys will be boys."

The reality is that he wasn't comfortable with the fact that certain boys that looked a certain way were doing all of the bullying, so it was more convenient for him to ignore the problem.

The Chicago police superintendent who called this attack "childish stupidity" needs to go. We're all guilty of childish stupidity. Childish stupidity is making a mess in the kitchen and blaming it on the cat. Torturing someone and livestreaming it on the internet is not childish stupidity. His attitude towards this makes it abundantly clear that he should not be in any kind of leadership role within the police department of a city facing a massive crime wave.

It's most definitely an agenda. Look at the Democratic strategist who said it wasn't a hate crime. Edit: Her name is Symone Sanders (I assume no relation), and she was Bernie's campaign spokesperson. She actually said that because of slavery it's not the same thing, and had previously said "We don't need white people leading the Democratic party right now," What a tool.

Honestly I lean left, I have mostly respect for Obama and I really like Bernie, but if these are the people who are leading the Democratic Party then fuck 'em. Racial issues dominated and IMO really tainted the last two years of Obama's presidency, and it wasn't only the justified responses to police shootings. There were a lot of violent, racially inflammatory rhetoric and actions associated with BLM, Ferguson, Baltimore, etc. and it really turned a lot of people off the Democrats. Maybe we need to form a third party and exclude these sort of people to have real progress.
