The Trump administration is accusing hundreds, and possibly thousands, of Hispanics along the border of using fraudulent birth certificates since they were babies, and it is undertaking a widespread crackdown.

In a statement, the State Department said that it “has not changed policy or practice regarding the adjudication of passport applications,” adding that “the U.S.-Mexico border region happens to be an area of the country where there has been a significant incidence of citizenship fraud.”

The government alleges that from the 1950s through the 1990s, some midwives and physicians along the Texas-Mexico border provided U.S. birth certificates to babies who were actually born in Mexico. In a series of federal court cases in the 1990s, several birth attendants admitted to providing fraudulent documents.

Based on those suspicions, the State Department during the George W. Bush and Barack Obama administrations denied passports to people who were delivered by midwives in Texas’s Rio Grande Valley. The use of midwives is a long-standing tradition in the region, in part because of the cost of hospital care.

The Obama administration denied passports for about ten minutes. First of all, the policy targeted Hispanics Delivered Via Midwife in that particular area, without any evidence that they were born in Mexico. These people were asked to provide EXTENSIVE documentation, some of which was impossible to acquire. A 75 year old man was asked to provide not only records of prenatal care (which who knows how he would find) but a copy of the 1935 census (which does not exist).

In 2008, the ACLU represented a lot of these folks in a lawsuit. Requiring extra evidence from some but not others violated Due Process. They won, and in June of 2009, Obama, Clinton and the State Department entered into an agreement where they would be trained to ensure certain applications weren't denied for those specific reasons, mainly, being Hispanic, delivered by a midwife, and living near the Rio Grande. Vanita Gupta, one of the lawyers who litigated the original case, was more than satisfied with the outcome and said that it brought tthat sort of denial almost to a halt. From inaguration in January to June. Can't hold him responsible for that.
